Clarification – Quota for Appointment under Rule 17A dt 13.09.2004

Subject: Quota for Appointment
Kindly refer to your letter No.9988 dated 23-08-2004 on the subject noted above.
2. It is stated that the questions raised in your letter referred above are answered in an annotated form as under:-

1. | Government has fixed the following quotas for filling up of vacancies: i) 20% quota of Junior Clerk to be filled from among class-IV civil servants. ii) 20% quota for sons/daughters of working employees in BS-1 to 5. iii) 20% quota for disabled persons. Clarification is required as to how the quotas are to be calculated. | Calculation of quotas is always made on the basis of over all cadre strength of the posts. This principle is laid down in the Ratio of Recruitment Rules. |
2. | No limit has been fixed for filling of vacancies under Rule-17-A. Some time the applications are in excess of the number of available vacancies. Whether the metric is to be determined: i) On the basis of the date of death/date of incapacitation. ii) On the basis of first come first served. iii) On the basis of the objective criteria. iv) Whether recruitment is a continuous process or some date has to be fixed in a year for calling applications. | No limit can be fixed for filling up of vacancies under Rules-17-A. In case the number of applications exceeds the available vacancies, then the recruitment may be made on availability of vacancy. For determining the merit, date of death/incapacitation is the only criteria. Recruitment under this rule has to be made without observing the recruitment procedure; however, qualification of the post has to be adhered to. Recruitment under this rule is a continuous process as the death of a government employee cannot be fore sighted. |
3. | The following clarifications with regard to Rules 17-A have been requested: i) While filling in vacancies local candidates are preferred but no definition of local candidate is available. ii) While filling up of vacancies (BS-5)(Junior Clerk) it is not clear as to whether candidates under Rules 17-A must pass the typing test. | Rule 20 of the Punjab Civil Servants (Appointment & Conditions of Service) Rules, 1974 requires posts in connection with affairs of provinces shall be filled from persons domiciled in the province of Punjab in accordance with merit. As such persons domiciled in Punjab are eligible for appointment on merit against any government post provided they are otherwise eligible as per service rules of the post. |
4. | It has been suggested that some % age of vacancies may be reserved for appointment under Rules 17-A as process of recruitment of staff on merit is minimized due to the number of vacancies available. | No % age of vacancies under Rules 17-A can be reserved as this is a benevolent provision which is applicable only at the time of death of a government employee. |
5. | In some cases son/daughter/widow are married at the time of applying under rule 17-A. | Married son of the deceased government servant may be given appointment under rules 17-A if he is not employed. However, daughter/widow cannot claim the benefit after marriage. |
6. | Children once getting benefit under this rule again apply for appointment against another post and also lodge appeals to higher forums. Guidance has been sought. | This may be made clear that benefit under Rules-17-A is a one-time dispensation and cannot be claimed again and again. This benefit is available to one child of the deceased employee only. |
