Clarification – Refusal of Leave Encashment dt 15.08.2024
OFFICE MEMORANDUM
Subject: Refusal of Leave Encashment
I am directed to refer to the subject cited above and to state that Mr. Muhammad Adil Saeed (PMS/BS-17/Retd.), ex-Section Officer, S&GAD, has requested for grant/ sanction of leave encashment w.e.f. 01.03.2023 to 31.05.2023 (Copy enclosed).
2. It is pointed out that Finance Department vide its circular letter dated 01.06.2023, has made the following amendments in Rule 17 of Revised Leave Rules (RLR), 1981, regarding grant of Leave Encashment in lieu of LPR (copy enclosed):
K) After sub-rule (6-C) the following new sub-rule (7) has been inserted:
- “A civil servant, who desires to get the benefit of encashment of LPR for a maximum period of three hundred and sixty-five days, shall submit his written application to the Appointing Authority for grant of LPR, at least three months before the date of commencement of his LPR and if, the Appointing Authority so refused his request, he shall be entitled to encashment of refused LPR for three hundred and sixty-five days equal to initial pay of basic pay scale”.
3. Mr. Muhammad Adil Saeed (PMS/BS-17/Retd.) retired from government service on 03.03.2024 on attaining the age of superannuation (copy enclosed). His LPR commenced w.e.f. 04.03.2023 to 03.03.2024. As per amendment dated 01.06.2023 in RLR, 1981, the LPR of the officer w.e.f. 01.06.2023 to 03.03.2024 was required to be refused by the Competent Authority for grant of leave encashment. However, the Competent Authority has rejected his request for refusal of LPR for the period w.e.f. 01.06.2023 to 03.03.2024 (copy enclosed).
Hence, the officer is not entitled for leave encashment w.e.f. 01.06.2023 to 03.03.2024. Whereas, he is only entitled for leave encashment of 89-days w.e.f. 04.03.2023 to 31.05.2023 in lieu of LPR according to amended Revised Leave Rules, 1981 read with Finance Department’s clarification dated 28.09.2023. However, office of AG Punjab, has issued leave title certificate to the officer, wherein, it has been certified that 277-days leave encashment w.e.f. 02.03.2023 to 03.12.2023 in lieu of LPR is admissible to the officer under RLR, 1981 (copy enclosed).
As the RLR, 1981 has been amended by the Finance Department, where, admissibility of leave encashment has been made mandatory with the refusal of LPR by the Competent Authority, hence, the leave title certificates regarding admissibility of leave in lieu of LPR are required to be issued in the light of orders regarding refusal/ not refusal/grant of LPR.
4. I am, therefore, directed to request that the concerned quarter may be directed to issue revised leave title certificate regarding admissibility of leave encashment in respect of Mr. Muhammad Adil Saeed (PMS/BS-17/Retd.), under amended Revised Leave Rules, 1981.
