Subject: Judicial and Utility Allowance
With reference to your letter No.DAO/BWP/119 dated 11.10.2024 on subject cited above.
- Attention is invited toward Government of the Punjab, Finance Department letter bearing No.FD.SR-IV/3-32/2020 dated 07.01.2025 (copy enclosed). You are advised to proceed further in the matter accordingly.
I am directed to refer to your letter No. KMP&R/2-3A(iv)/161/2021-24/4734, dated 28.10.2024 on the subject cited above.
- The case has been examined. The Finance Department has already clarified vide letter bearing No. FDSR-1-9-1/99(P-I) dated 27.04.2010 (copy enclosed) that the Labour Court, Anti-Corruption Court, Anti-Terrorism Court, Drugs Courts, and Consumer Courts do not come under the Administrative Control of Lahore High Court, Lahore. Hence, these Courts do not fall in the ambit of the subordinate judiciary.
Moreover, the instant matter is subjudice before the August Supreme Court of Pakistan vide C.P. No. 1462/2019 etc., in which the impugned judgment has already been suspended vide order dated 29.06.2017 passed by the Supreme Court of Pakistan in C.P. No. 1252-L/2017 (copy enclosed). Therefore, those Consumer Courts which are in the receipt of judicial/utility allowance are subject to recovery of the same.
