Retirement on Medical Ground after Issuance of Superannuation Notification dt 08.11.2018

Subject: Issuance of Superannuation
Kindly refer to the subject noted above.
It is submitted that Mr. Khalid Mehmood Kanwar, Excise & Taxation Inspector was working in the office Director Excise & Taxation Bahawalpur. The Officer was going to be superannuated w.e.f. 02-09-2018 and Orders for Retirement on Superannuation was issued by the Director Excise & Taxation Bahawalpur vide No. 2159-61/Estt, dated: 11-07-2018 (Annexure-A).
Later on, In supersession of earlier Order No. 2159-61/Estt, dated: 11-07-2018, The Director, Excise & Taxation Bahawalpur vide No. 2519-12/Estt, dated: 29-08-2018 allowed him to retire from Government Service w.e.f. 01-08-2018 on Medical Grounds (Annexure – B).
As per Finance Department Letter No. FD.SR-III-4-151/2011, dated: 29-02-2012 (Annexure-C), “Rule 3.5 Note (1) of the Punjab Civil Services Pension Rules mentions that the date of retirement once accepted by the competent authority shall be final”
This office is of the view that Director Excise & Taxation Bahawalpur orders passed by the Director, Excise & Taxation Bahawalpur regarding retirement on medical ground is in violation of Finance Departments policy / instruction as Superannuation Orders were already been issued by him.
It is, requested that view point of this office may please be confirmed or necessary advice may please be provided to proceed further in the matter.
Please refer to your letter No.DAO/BWP/PEN/HM/25072, dated 26th October, 2018 on the subject noted above.
2. The viewpoint of your office, as mentioned vide Para-5 of letter referred to above, is hereby confirmed.
