Subject: Fixation of Pension under Pay Package
Various District Accounts Offices are approaching this office for clarification that whether pension of the pensioners who retired on or after 01/07/2005 is to be refixed in the light of Punjab Finance Department Letter No-FD-SR-III/5-1/2015 dated 13/04/2017.
In this regard, this office is of the view that there is no pay package 2005. The only change made in 2005 was that the maximum limit of commutable pension amount was reduced from 40% to 35%. Thus the question raised is not rational. All pensioners who retired on or after 01/07/2001 are entitled for restoration of commuted portion of pension after omission of Para 16(e) of letter 2001 vide Finance Department Letter No-FD-SR-III/4/41/2008 dated 22/07/2014.
Refixation of pension of such pensioners is to be dealt with in accordance with para 1 of Government of the Punjab Finance Department Letter No-FD-SR-III/5-1/2015 dated 13/04/2017, which clearly states that “this benefit shall be admissible on due dates of restoration of commuted pension, on or after 01/04/2017 to the similar pensioners as well.” However, no arrear is admissible prior to date of restoration.
Views of this office narrated in para 2 above has been confirmed by Finance Department Government of the Punjab vide No. FD-SR-III/5-1/2015 dated 16/01/2018.
Thus, the pension of all the pensioners, who retire on or after 01/07/2005 under 35-65% formula is also to be refixed w.e.f. the due date of restoration like those who retired under pay and pension package 2001.
