Subject: Family Pension to Disable Son
I am directed to refer to your letter bearing No.IT(FD)(TT)10-2/2020(part-II), dated 01-01-2024 on the subject noted above
The case has been examined in the Finance Department in the light of policy letter of Finance Department bearing No.FD.SR.III.04-111/89, dated 22-07-1989 (copy enclosed) which provides that pension to physically / mentally retarded children will be admissible for life, subject to the production of the certificate from the medical board the children is physically / mentally retarded permanently and not able to be gainfully employed. Further, Para-8(b) of the Finance Department’s circular letter bearing No.FD.-PC-2-2/94, dated 18-07-1994 provides as under (copy enclosed):
“Grant of family pension to the dependent disabled / retarded children for life without any age limit.”
Furthermore, no other conditions are mentioned therein. However, it is for the Pension Sanctioning Authority to decide the entitlement in the light of aforementioned policy letters by observing all legal / local and procedural formalities.
