Clarification – Leave Encashment or LPR Refusal dt 06.05.2025

Subject: Leave Encashment
I am directed to refer to your letter bearing No.TM-1/1-1A/2017-22/HM-4790, dated 15.01.2025 on the subject noted above.
2. The case has been examined and it is observed as under:

Whether the Civil Servant who desires to get the benefit of encashment of LPR is bound to submit the written application to Appointing Authority at least three months before the date of commencement of his LPR or can also apply for encashment of LPR even after the start of LPR period under Rule 17(1)(k) of Revised Leave Rules, 1981 or otherwise. | A civil servant is bound to apply to the Appointing Authority for grant of the benefit of leave encashment in lieu of L.P.R. at least three months before the commencement date of the L.P.R. in terms of Rule 17(7), Revised Leave Rules, 1981. However, in case the L.P.R. period falls partly before 01-06-2023 and partly on or after 01-06-2023, then no refusal for grant of the leave encashment for the period up to 31-05-2023 is required. As regards the part of the L.P.R. which falls on or after 01-06-2023, the attention is drawn towards serial # 1 of the clarifications issued in this regard vide letter No. FD-SR-II/2-97/2019(Part), dated 28.09.2023(copy enclosed). Moreover, he is not entitled for the benefit of the encashment for the L.P.R. period which falls on or after 01-06-2023, in case he applies to the Appointing Authority after his/her retirement. |

Whether the appointing authority is bound to refuse the LPR before the start of LPR period or after the start of LPR period after the written application of civil servant to Appointing Authority under Rule 17(1)(k) of Revised Leave Rules, 1981 or otherwise necessary clarification may be issued. | The benefit of the leave encashment in lieu of the L.P.R. in terms of Rule 17(7) of the rules ibid, is admissible subject to the refusal by the Appointing Authority. However, it is the discretion of the Appointing Authority regarding refusal or sanction of the applied L.P.R |
I am directed to refer to this Department’s Notification of even No. dated 01.06.2023 on the subject cited above and certain clarifications upon queries in this regard are notified for the convenience and guidance of all concerned as under:

A civil servant whose LPR period is completed before 31.05.2023, there is no need of getting refusal by the Competent Authority for encashment of leave. |

8. | Whether the ibid Notification applies to those officers who have already been retired, in the month of May, 2023 or earlier? | The said amendment in the Revised Leave Rules, 1981 is applicable w.e.f. 01.06.2023 and does not apply to those civil servants who already retired before 01.06.2023. |
