Clarification – Upgradation of Computer Operator on Prescribed Qualification dt 25.09.2020

Subject: Upgradation of Computer Operator

I am directed to refer to the subject cited above and to inform that Mr. Babar Hussain, Computer Operator, SIMS/Services Hospital, Lahore has filed the subject Writ Petition in the Hon’ble Lahore High Court, Lahore. He has annexed following precedents in his petition:

i) Letter No.PF/424-439/E&A dated 03.01.2019 issued by Chief Executive Officer District Health Authority, Rawalpindi.
ii) Letter No.PF/408-423/E&A, dated 03.01.2019 issued by Chief Executive Officer (DHA), Rawalpindi.
iii) Letter No.PF/473-489/E&A, dated 03.01.2019 issued by Chief Executive Officer (DHA), Rawalpindi.
iv) Letter No.434-625/E-II, dated 15.01.2019 issued by Chief Executive Officer (DHA), Gujranwala.
v) Letter No. DHO(MIS/HRM)267-88/Est, dated 16.01.2019 issued by District Health Officer (MIS/HRM) (DHA) Rahim Yar Khan.
vi) Letter No.1775-84/E, dated 14.01.2019 issued by Chief Executive Officer District (DHA), Gujrat.
vii) Letter No.CEO.1976-86, dated 28.01.2019 issued by Chief Executive Officer District (DHA), Bhakkar.

2. The above cases have been examined and it is observed that the above orders / Notifications regarding up-gradation of posts of Computer Personnel were issued on the basis of current / possessed qualification, whereas according to subject Notification, up-gradation has been allowed on the basis of prescribed qualification. Hence, these orders / Notifications are contrary to Finance Department’s Notification No.FD.PC.40-43/2017(E), dated 14.12.2018. 

3. I am, therefore, directed to request to issue directions to lower formation for withdrawal of orders and to send case to Finance Department for advice in a self-contained manner by providing copy of Service Rules, date of appointment of applicants, prescribed qualification of the post, up-gradation already availed by the applicants, promotion already availed by the applicants, etc., to proceed further in the matter.

1. Order No.DHO(MIS/HRM)267-88/EST, dated 16.01.2019 issued by Chief Executive Officer (DHA), Rahim Yar Khan.
2. Order No.PA/11744-75/CEO-DHA, dated 09.10.2019 issued by Chief Executive Officer (DHA), Bahawalpur.
3. Order No. Nil, dated 04.04.2019 issued by Chief Executive Officer (DHA), Attock.

In pursuance of Government of the Punjab, Finance Department Lahore letter No. FD.PC.40-43/2017 (E) dated 14.12.2018 & Government of the Punjab, Primary & Secondary Healthcare Department letter No. SO (ND)1-61/2018 dated 31.12.2018 & on the recommendations of Scrutiny Committee in its meeting held on 04.10.2019; the following Computer Operators BS-12 are hereby re-designated as Junior Computer Operator and on completion of eight years of regular service, timescale promotion as Computer Operator BS-15 is hereby granted with effect from 14.10.2017:
