- The Regulations Wing, S&GAD has examined the matter and it is observed that Rule 17-A of the Punjab Civil Servants (Appointment & Conditions of Service) Rules, 1974 has been omitted after approval of the Punjab Provincial Cabinet, hence, no question arises for making appointment under Rule 17-A of the rules ibid.
ADVICE UNDER RULE 17-A IN THE PUNJAB CIVIL SERVANT (APPOINTMENT AND CONDITIONS OF SERVICE) RULES, 1974.
I am writing to seek clarification regarding the Punjab Government Notification No. SOR-III (S&GAD)2-60/2024 dated 24.07.2024, specifically its applicability concerning cases of invalidation or death.
As per my understanding, there is some ambiguity about whether this notification applies only to cases of invalidation or death that occurred after the date of the notification or if it is applicable to all cases, irrespective of whether they occurred before or after the date of the notification.
Given that I have received a number of applications for appointment under rules 17-A, it is imperative to ascertain the correct interpretation of this notification to proceed accordingly. Therefore, I kindly request your guidance on this matter.
Could you please clarify:
- Whether the notification applies solely to cases occurring after the date of issuance.
- Whether it also encompasses cases of invalidation or death that occurred prior to the date of the notification.
Your prompt response and advice on how to handle the applications under the stipulated rules will be highly appreciated, as it will enable me to process the applications in accordance with the regulations.
An “Appointment under 17A” likely refers to a section of a legal framework, such as the Constitution or a specific Act (e.g., a Civil Service Act), but without context, I’ll provide a general explanation. Section 17A usually deals with specific appointments in government or public services, setting out the conditions and procedures under which such appointments are made.
In this case, we have an appointment letter or document dated 13th August 2024 under Section 17A. Here’s a simplified explanation of what this might entail:
Key Points of Section 17A Appointment:
- Legal Framework:
Section 17A of the relevant law governs appointments within a specific sector, typically public or government services. This section outlines the qualifications, processes, and legal requirements for the position. - Eligibility and Criteria:
Usually, the person being appointed under Section 17A must meet specific eligibility criteria, such as relevant experience, qualifications, or fulfilling a certain role. The law ensures that the appointment process is transparent and merit-based. - Appointment Process:
The appointment under Section 17A follows a formal procedure. The individual may be selected through a nomination, examination, or interview. The date mentioned in your case, 13th August 2024, is likely when the official appointment was confirmed or formalized. - Responsibilities of the Appointee:
Once appointed, the individual assumes the responsibilities as outlined by the specific law or job role. This could include anything from administrative duties to fulfilling a special governmental function. - Legal Implications:
The appointment under Section 17A might come with specific legal conditions, such as probationary periods or specific terms of employment. It also ensures that the appointment is lawful and aligned with the public service code of conduct. - Appeal or Challenges:
If there are any disputes or challenges regarding the appointment, these might be addressed through appeals or legal actions as per the framework of the law. This is often laid out in subsequent sections of the law.
Conclusion:
An appointment under Section 17A, such as the one made on 13th August 2024, usually signifies that an individual has been chosen for a particular role within the framework of a public or government service. The appointment is done according to the legal guidelines outlined by this section, ensuring a fair and lawful process. The date likely represents when the appointment became official, and the appointee is expected to fulfill their duties as per the law. Any challenges to this appointment would need to follow legal procedures outlined in the same framework.
This simplified summary covers the general aspects of an appointment under a legal provision like 17A, but for exact details, reviewing the specific law governing the appointment is necessary.
